Terms of Service

Please read these Terms of Service (“Terms”) carefully before using ViaPlot (“the Service”) operated by [LEGAL ENTITY NAME] (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

ViaPlot is an interactive map storytelling platform that allows users to create, edit, publish, and share maps enriched with Points of Interest, media content (images, video, audio), and multilingual descriptions.

2. Eligibility

You must be at least 16 years old to use the Service. By registering, you confirm that you are of eligible age and have the legal capacity to enter into this agreement.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at hello@viaplot.com of any unauthorised use of your account. We are not liable for any loss resulting from unauthorised use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, publish, or share unlawful, harmful, or infringing content
  • Violate the intellectual property rights of others
  • Harass, threaten, or harm other users
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Engage in automated scraping, crawling, or data extraction without prior written consent
  • Use the Service to send unsolicited commercial communications (spam)
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

5. User Content

You retain ownership of all content you create and upload to ViaPlot (“User Content”). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, process, and transmit your content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to upload the content and that it does not violate any applicable law or third-party rights.

6. Public Maps and Sharing

When you publish a map as “public”, it becomes accessible to anyone with the URL. You are responsible for ensuring that any publicly shared content complies with applicable law. We reserve the right to remove public content that violates these Terms or applicable law.

7. Storage and Quotas

We may apply storage quotas per account. We reserve the right to modify quota limits with reasonable notice to affected users.

8. Intellectual Property

All elements of the ViaPlot platform — including the software, design, logos, and brand assets — are the intellectual property of [LEGAL ENTITY NAME] and are protected by copyright and other applicable laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

9. Third-Party Services

The Service integrates third-party services including Mapbox (map rendering), Stripe (payments), Resend (email), and Cloudflare Turnstile (bot protection). Your use of these integrations is subject to the respective third-party terms and privacy policies.

10. Payments and Subscriptions

Paid features, when available, will be billed through Stripe. All prices are displayed inclusive of applicable taxes. Subscription fees are non-refundable except as required by EU consumer protection law (including the 14-day statutory right of withdrawal for digital services, where applicable). Details will be provided at the point of purchase.

11. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, with or without prior notice depending on the severity of the violation. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by applicable law, our total liability for any claim arising from or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Nothing in these Terms limits liability for death, personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under EU law.

13. Governing Law and Jurisdiction

These Terms are governed by the law of [COUNTRY — EU Member State]. Any disputes shall be subject to the exclusive jurisdiction of the courts of [CITY/REGION], without prejudice to your rights as a consumer under mandatory EU law.
